Terms & Conditions

Please read the Prolift Purchase Terms & Conditions (Terms & Conditions) carefully to ensure that you are fully aware of your rights and our obligations to you when purchasing products (the Products) from the Prolift website, which is displayed at www.prolift.com.au (the Website).

Your completion and submission of your order signifies your agreement to be bound by these Terms & Conditions, which constitute the agreement between Prolift Solutions Pty Ltd ACN 141 970 836 (Prolift) and you. Any variation of the Terms & Conditions must be in writing and signed by a Prolift representative.

SECURITY
When purchasing from Prolift your financial details are passed through a secure server using the latest 128-bit SSL (Secure Sockets Layer) encryption technology secured by GeoTrust (www.geotrust.com). 128-bit SSL encryption is approximated to take at least one trillion years to break, and is the industry standard. PURCHASES
The person making a purchase via the Website will be deemed to have accepted these Terms & Conditions on behalf of the persons or business entities named in the order form (if different from the person making payment).

You must provide full and accurate personal details at the time of placing your order with us.

We accept government official purchase orders on a 30day account. This offer does not include modified or purpose built products.

PURCHASE PRICE
All prices quoted on the Website or pursuant to your enquiry with us are in Australian Dollars (AUD) and exclude GST (Goods and services tax) and shipping cost. We reserve the right to vary the prices displayed on the Website from time to time and without notice to you. Product prices are regularly updated when price changes are received from our suppliers. If you find a cheaper advertised price somewhere else, email or phone us with the details of the supplier together with prices of the product required and we will endeavour to provide you with a more competitive price.

Our prices do not include transport insurance or any secondary attempts to deliver ordered goods to you.

Any goods purchased by you are purchased on a supply only basis and the purchase price does not include installation of the goods.

You accept total responsibility for the goods purchased by you and you use the goods at your own risk.

PAYMENT
Prolift accepts payment via credit card payment using AMEX, VISA or MASTERCARD (Processing Fees apply) and DIRECT DEPOSIT.
When paying for your order via credit card, you will receive a transaction confirmation email, which confirms receipt of your order.

For Visa & Mastercard the rate is 2% of the total payment amount.

For American Express (AMEX) the rate is 3.5% of the total payment amount.

We will not accept as a form of payment any credit card, which has been issued by a bank outside of Australia.
When paying for your order via direct deposit, you may request from us a Tax Invoice prior to completing your order.
Irrespective of payment method, we will email you a Tax Invoice relating to your order once we have received your payment in cleared funds.

PRODUCT WARRANTIES
All goods sold on the Website are covered by the standard warranty provided by the manufacturer of the subject goods. The terms of warranties will vary between manufacturers. Prolift in no way provides a separate warranty of any kind with respect to the goods purchased by you, except as may be required under any relevant consumer protection laws.

You will be solely responsible for all freight charges that may be incurred by you as a consequence of shipping goods to the manufacturer for assessment or replacement.

Prolift will not be liable for any alteration or variation in the goods made by a manufacturer or supplier of the goods.

RETURN OF GOODS
Any return of goods to us by you will be governed in accordance with our Returns Policy.

PROCESSING OF ORDERS
We will only process orders on business days, which are Monday to Friday and exclude Queensland public holidays. If you place an order on a non-business day, we will process that order on the next business day.

SHIPMENT OF ORDERS
We deliver goods Australia-wide, shipped directly to you from our suppliers located across Australia. This allows us to keep our prices down as low as possible. Depending on your geographical location, you may elect to personally pick up your ordered goods from our supplier. This will result in further savings to you.

Shipping costs are influenced by the size and weight of the product and your location, exact shipping cost are NOT calculated in the shopping cart before checkout. We will contact you via email or telephone with a firm and fair delivery cost after you have placed your order, alternatively you can contact us for a shipping quote prior to placing your order.  If you accept our quoted delivery cost you will be required to pay the delivery cost (in addition to the cost of the goods ordered) prior to us dispatching the goods to you. 

If you prefer, you may personally organise delivery of the goods. In such case, you will be required to provide us with your freight account details so we can make delivery arrangements with your preferred freight company.

We will only deliver goods to physical addresses and not to post office boxes. If our freight carrier cannot deliver the goods to your physical address on the first attempt, you will be required to pay any reasonable costs associated with any further attempts to deliver the goods.

At this time we do NOT accept international orders through our website, please contact us via email at sales@prolift.com.au to enquire about a special order.

TRACKING ORDERS
We will provide you with details relating to your order once the goods have been dispatched.

UNLOADING GOODS
Due to the physical size and weight of some goods, not all freight carriers will be capable of unloading all goods. Therefore, it is your responsibility to let us know about your unloading requirements prior to confirmation of the freight carrier so that we can work with you to ensure that the goods can be successfully delivered to you.

You will solely be responsible for any third party costs that may be incurred as a result of special delivery requirements.

DELIVERY TIMES
Standard products without modifications are despatched within 2 business days and shipping times are estimated at between 2-10 business days depending on your location within Australia. 

Goods that are especially manufactured to order will have an indicative lead time displayed on the product page of the Website. We will provide you with an expected lead time once your payment has been processed and if we become aware that the expected lead time will not be met, then we will contact you via telephone or email to inform you of such delay. 

Delivery dates or times indicated by Prolift on acceptance of your order are approximate only and do not constitute a guarantee of delivery or delivery by such date. Therefore, your non-receipt of ordered goods within the expected lead time will not be grounds for you to cancel your order or receive a refund.

CANCELLATION OF ORDERS
Prolift may cancel your order if it is for any reason unable to provide you with the goods subject to your order.

You will not be entitled to claim any additional amounts or seek compensation for any loss, expense or damage (either direct or consequential) or for any loss of time or inconvenience, which may result from such cancellation.

You are NOT entitled to a refund if you:

*  change your mind or don't want it

*  realise you can't afford it

*  find the same item at a cheaper price elsewhere

*  knew about the fault before you bought it

*  caused the fault.

TITLE IN GOODS
Notwithstanding delivery of the goods or their installation, title in any particular goods will remain with Prolift until you have paid and discharged any and all monies owing pursuant to any invoice issued by us in relation to the goods, including all applicable GST.

RISK IN GOODS
The risk in the goods will pass to you upon delivery of the ordered goods to you or to a freight carrier company nominated by you.

LOWEST PRICE GUARANTEE
At Prolift, our aim is to provide quality lifting products at competitive prices. If you happen to find a lower price on the same product, let us know via email and we will adjust our prices accordingly saving you $$$. Just email your genuine quote prior to purchasing to:

WHAT ARE THE EXCLUSIONS?
* Offers by classifieds, auction sites, manufacturers or importers.
* Commercial quantities & contract pricing.
* Advertising errors (either ours or competitors)
* Special offers, clearance products, discount offers or closing down sales.
* Competitors must be located within Australia.

JURISDICTION
The laws of Queensland govern this agreement.
